What to Do After a Serious Car Wreck in Oklahoma

Table of Contents
1. At the Scene of the Crash
The first few minutes after a wreck are chaotic, but they are crucial for your case. Your priority is safety. Once you are safe, you need to collect evidence.
- Call 911: In Oklahoma City, police may not respond to minor accidents during bad weather, but always try. A police report is the best neutral evidence.
- Photos: Take pictures of the damage to ALL vehicles, skid marks, and traffic signs.
- Witnesses: Get names and phone numbers. They might leave before police arrive.
2. Seek Medical Attention Immediately
Adrenaline can mask pain. You may have a concussion, whiplash, or internal bleeding without realizing it. Go to an ER or Urgent Care immediately. If you wait days or weeks, the insurance company will argue your injuries were not caused by the crash.
3. Dealing with Insurance Adjusters
WARNING: The other driver's insurance adjuster is not your friend. Their job is to pay you $0.
- Do NOT give a recorded statement.
- Do NOT sign a medical release form.
- Do NOT accept the first settlement offer (it is always a "lowball").
Refer all calls to your attorney.
4. Statute of Limitations
In Oklahoma, you generally have two years from the date of the accident to file a lawsuit (Title 12 O.S. § 95). If you miss this deadline, your case is gone forever. This is why it is critical to hire an attorney early.
